Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual as "Personal Information".

Purpose: To load the Site accurately and to perform analytics on Site usage to optimise our Site.

Order information

Purpose: To fulfil your order, process payment, arrange shipping, provide invoices and order confirmations, communicate with you, screen for fraud, and where you have agreed, to send you information about our products and services.

Data collected: Name, billing and shipping address, payment information, email address, and phone number.

Minors

Our products are designed to be used by or under the supervision of adults. They are not suitable for children under 3 years as physical toys, but this Site is intended for adult shoppers. We do not knowingly collect Personal Information from children under 13. If you believe your child has provided us with Personal Information, please contact us at info@turtlecreations.co.nz to request deletion.

Sharing Personal Information

We share your Personal Information with third-party service providers to help us operate our business and fulfil our obligations to you, including:

  • Shopify — our ecommerce platform. See Shopify's privacy policy.
  • Advertising and analytics partners as described in the Behavioural Advertising section below.

We may also share your Personal Information to comply with applicable laws and regulations, or to respond to a lawful request from a government authority.

Behavioural Advertising

We use your Personal Information to deliver targeted advertising and marketing communications that we believe may be relevant to you. We work with the following advertising and analytics platforms:

Meta (Facebook & Instagram)

We use the Meta Pixel and Meta Conversions API for advertising, retargeting, and campaign measurement. Unlike pixel-only tracking, the Conversions API sends data directly from our server to Meta, meaning it operates independently of your browser settings or ad blockers.

We use Meta's Advanced Matching feature, which means that when you make a purchase or interact with our Site, we send Meta the following information in hashed (encrypted) form: email address, phone number, first name, last name, city, state/province, postal code, country, date of birth, and gender. Meta uses this to match your activity to your Facebook or Instagram account for ad measurement and targeting purposes.

Google (Ads, Analytics, YouTube, Remarketing)

We use Google Analytics, Google Ads, and YouTube integrations for analytics, advertising, and remarketing.

We use Google's Enhanced Conversions feature, which sends a hashed version of your email address to Google when you complete a purchase. This helps Google accurately attribute purchases to ads you may have seen.

We also use Google Customer Match, which allows us to upload hashed customer lists (email addresses) to Google so that we can show ads to existing customers or similar audiences across Google Search, YouTube, and Gmail.

Shopify Collabs

We use Shopify Collabs for our influencer and affiliate programme. If you are a collaborator or have been referred through a collaborator link, data about your visit and any resulting purchases may be shared for commission tracking purposes.

Purpose Limitation

In accordance with the New Zealand Privacy Act 2020 (Information Privacy Principles 1 and 10), we only collect Personal Information that is necessary for a lawful purpose connected with our business activities. We do not use your Personal Information for any purpose other than the purpose for which it was collected, unless we have your consent or the secondary use is directly related to the original purpose.

The primary purposes for which we collect Personal Information are:

  • Fulfilling and managing your orders, including payment processing and shipping
  • Providing customer support and responding to enquiries
  • Detecting and preventing fraud
  • Operating, improving, and securing our Site

Secondary purposes (where you have opted in or where permitted by applicable law) include:

We will take reasonable steps to do so. If we disagree with your correction request, we will not simply refuse — instead, we will attach a statement of correction to your record noting the correction you requested and our reason for disagreement. This ensures that anyone accessing your Personal Information in future is aware of your position alongside our record.

Your Rights — EEA Residents (GDPR)

If you are a resident of the European Economic Area, you have the right to access, port, correct, update, or request erasure of your Personal Information. Please contact us to exercise these rights.

Pursuant to the GDPR, we process your personal information under the following lawful bases: your consent; performance of the contract between you and us; compliance with our legal obligations; and our legitimate interests, which do not override your fundamental rights.

Your Rights — California Residents (CCPA/CPRA)

If you are a resident of California, you have the right to know what Personal Information we collect and how it is used, to request correction or deletion of your data, and to opt out of the sharing of your Personal Information with third parties for advertising purposes.

Our Site DOES NOT sell Personal Information as defined by the CCPA. However, our use of advertising pixels and the Conversions API may constitute "sharing" of Personal Information with third parties (Meta, Google, TikTok, Pinterest) for cross-context behavioural advertising.

Cookies

A cookie is a small file downloaded to your device when you visit our Site. We use functional, performance, advertising, and social media cookies. You can control cookies through your browser settings. Please note that disabling cookies may affect your experience on our Site.

For EU/EEA visitors, we display a cookie consent banner and will only activate non-essential tracking cookies with your consent.

Retention

Artificial Intelligence and AI Training

We do not use your Personal Information to train artificial intelligence or machine learning models, whether operated by us or by third parties. We will not sell, license, or otherwise make your Personal Information available for AI training purposes.

Shopify, as our ecommerce platform, may use aggregated and anonymised store data to improve their own platform and services. For details on how Shopify uses data, please refer to Shopify's Privacy Policy.

Automatic Decision-Making

We do not engage in fully automated decision-making that has a legal or otherwise significant effect on you. Shopify uses limited automated fraud detection (temporary IP and card blacklisting), which does not have a legal or significant effect on customers.

Do Not Track

Because there is no consistent industry standard for responding to "Do Not Track" browser signals, we do not alter our data practices when such a signal is detected. California residents may use the opt-out rights described above.
